These General Conditions of Sale concern the purchase of products carried out remotely via the web on the site https://www.moroder.wine/, sold directly by MORODER ALESSANDRO AZIENDA AGRICOLA, FRAZ. MONTACUTO 112, 60129 ANCONA (AN) (hereinafter MORODER), registered with the Chamber of Commerce, Industry, Crafts and Agriculture of the MARCHE region with number MRDLSN51E15H501F, Tax Code MRDLSN51E15H501F, VAT number: IT 01047540420
MORODER ALESSANDRO AGRICULTURAL COMPANY, FRAZ. MONTACUTO 112, 60129 ANCONA (AN) markets and partly produces the products on the Site.

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

These Conditions of Sale must be examined and accepted online by the Customers of the site https://www.moroder.wine/ before confirming the purchase. The order therefore implies full knowledge of the Conditions of Sale and their total acceptance. The Customer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these Conditions of Sale, already viewed and accepted during the purchase procedure carried out.
MORODER ALESSANDRO AZIENDA AGRICOLA reserves the right at any time to modify these Conditions of Sale by publishing a new version on this website. The applicable conditions of sale are those published on the site at the time the order is placed, as examined and accepted by the Customer.

WARRANTY

MORODER ALESSANDRO AZIENDA AGRICOLA declares that the products that will be delivered conform to those present and described on the online site and that the images of the products are to be considered illustrative and non-binding.
Any obvious defects must be reported by the Customer in accordance with the provisions of Legislative Decree no. 206 of 2005 art. 132.
The products purchased on the site https://www.moroder.wine/ are subject to the regulations, to the extent applicable, of Legislative Decree 206/2005 on consumer protection and, to the extent not covered therein, to the specific provisions set out in matter from the Civil Code.
With the exception of the replacement of defective and non-compliant products, MORODER ALESSANDRO AZIENDA AGRICOLA assumes no responsibility for direct or indirect damages that may arise from the use, even improper, of the product by the recipient.
The guarantee is personal and will therefore apply only to the original purchaser. Any defect in the products must be reported in writing by the Customer and documented with relative photographic material within the legal deadline at the time of reshipment of the defective product, reshipment which must be authorized in advance with MORODER ALESSANDRO AZIENDA AGRICOLA.
MORODER ALESSANDRO AZIENDA AGRICOLA reserves the right to verify the actual existence of the defect reported by the Customer and the customer has the discretion to choose between the compensation methods indicated in the return conditions. The request will be processed only if the following documents are present in the returned package: order number and date, detailed description of the defect found and the intact product in its original packaging.
The costs of returning the goods to the sender remain the responsibility of the Customer.

PURCHASE METHOD

Purchases of the products, available online and described in the relevant detailed sheets, are made by the Customer at the indicated price, plus any transport costs, as specified below. The Products are depicted and made visible on the Site accurately and corresponding to the characteristics they actually possess. MORODER ALESSANDRO AZIENDA AGRICOLA, in any case, is not able to guarantee the exact correspondence to reality in relation to the images and colors as they appear on the Customer’s monitor, if the discrepancy depends on the latter. Before confirming the order, the Customer will be provided with a summary of the unit cost of each product chosen, the total cost in the case of purchasing multiple products and the transport costs. With the order confirmation, the Customer will receive an email message containing the order details.

PRICES

All prices entered on the site are inclusive of VAT. The prices applicable for the products ordered by the Customer are those appearing on this site on the date on which the order is sent. Prices may be changed at any time, without notice, including for any promotions. Prices do not include shipping costs. Shipping costs are invoiced based on the rates indicated on this site on the date the order is placed and may be modified at any time without notice. Prices are expressed in Euros.

RECEIVING ORDERS

Purchases of the products, available as illustrated and described online in the relevant descriptive sheets, are made by the customer at the price indicated therein, to be confirmed at the time of forwarding the order confirmation, in addition to the transport costs as specified below and however displayed at the time of purchase.
Before confirming the purchase, the Customer will be given a summary of the unit cost of each chosen product, the total cost in the case of purchasing multiple products and the related transport costs. By confirming the purchase, upon completion of the transaction, the Customer will receive an email message containing the date and total amount of their order (for payments by bank transfer, PayPal, credit card).

DELIVERY OF GOODS AND SHIPPING COSTS

All orders placed will be delivered to the shipping address specified by you at the time of placing the order which can be your home or your workplace. In order for the delivery to be successful, it will be your responsibility to check that the address is correct, also leaving your telephone number and your e-mail address and that the indications on the doorbell/intercom button are clear and correspond to the name you indicated to receive the goods purchased by you.
If there are problems with the processing or delivery of the order, it is important that you can be contacted in order to agree on any changes.
In the days following the order, please check your email, as we may have sent you some communications regarding the processing of the order.
Orders will be processed within 24/48 hours (Monday to Friday) from the moment of final acceptance of the order which is only considered to be when your payment has been credited to our current account.
It is your responsibility to check the quantity and good condition of the goods at the time of delivery.
All shipments travel at the buyer’s risk: MORODER ALESSANDRO AZIENDA AGRICOLA does not assume any risks deriving from transport and/or changes in delivery times.
The shipping costs applied to each order vary based on the products chosen by the customer and the place of destination of the goods.
Minor Islands and remote areas may have longer delivery times and higher shipping costs which will be specified on the cart checkout page.

RIGHT OF RETURN

In the event that the customer is not satisfied with the items purchased, he has the right to exercise the right to return part or all of the goods included in an order without any penalty. The customer can exercise the right of return within 15 working days from the delivery date of the purchased products. The request must be sent by email to the following email address mail@moroder.wine and must specify the order number, the item(s) you wish to return, the reason and your contact details.
MORODER ALESSANDRO AZIENDA AGRICOLA will respond via e-mail giving authorization to return the goods. The shipment of the products to be returned can be carried out by any means chosen by the customer, but a shipment with traceability is advisable as the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer. However, MORODER ALESSANDRO AZIENDA AGRICOLA will in no case accept return shipments freight collect. Shipping costs will therefore be borne by the customer.
Once the returned products have been received, MORODER ALESSANDRO AZIENDA AGRICOLA reserves the right to verify the integrity of the goods, to ensure that the returned products are in the same conditions in which they were delivered. Verification can take up to 5 business days. Only after having certified the condition of the returned items, MORODER ALESSANDRO AZIENDA AGRICOLA will provide the refund within 14 days of receiving the returned goods.
Attention: Will not be accepted for replacement:
• Products without original or open packaging;
• Products used;
• Products damaged due to improper handling of the customer;
• Packages returned cash on delivery or freight collect.
Furthermore, affixing labels or adhesive tapes directly to the original packaging of the product must be avoided in all cases, under penalty of non-acceptance of the return.

REFOUND

The Customer will be entitled to a refund of the price paid for the purchase of a product if he is not satisfied with the purchase made. Shipping costs remain the responsibility of the Customer.
The refund will be made in the following ways:
• CREDIT CARD: for orders paid by credit card, the amount will be canceled by our systems and made available again on the customer’s account statement according to the times established by the banking institution that issued the card (generally the next month).
• PAYPAL: for orders paid with Paypal, the refund will be made directly to the Paypal account: a refund will be requested on the transaction to be paid by the customer, net of the cost of the operation.

Any complaint by the customer must be addressed to via registered mail with return receipt to:

FORCE MAJEURE

MORODER ALESSANDRO AZIENDA AGRICOLA will make all necessary efforts to maintain its obligations. However, MORODER ALESSANDRO AZIENDA AGRICOLA cannot be held responsible for delays or non-delivery caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural disasters and any other event that makes the production, transportation or delivery of the products impracticable.
MORODER ALESSANDRO AZIENDA AGRICOLA is not responsible for the actions of the courier due to delays and failed deliveries. For information you can contact the courier itself.
