Ownership of the site
The owner of the website WEB ADDRESS is MORODER ALESSANDRO AZIENDA AGRICOLA, (hereinafter MORODER) with registered office FRAZ. MONTACUTO 112, 60129 ANCONA (AN) (registered with the Chamber of Commerce Industry, Handicraft and Agriculture of MARCHE under the number MRDLSN51E15H501F, Tax Code MRDLSN51E15H501F, VAT no: IT 01047540420), and is aimed at selling products and services online.
Applicable legislation
The buying and selling of products and services through electronic means is governed by Articles 45 to 67 “Of Consumer Rights” of Legislative Decree. September 6, 2005 no. 206 (Consumer Code) and by Leg. April 9, 2003 no. 70 on electronic commerce. The sale and purchase agreement entered into between the Client and MORODER shall be governed by and construed in accordance with Italian Law.
Acceptance of the general conditions of sale
By placing an order according to the different methods provided on the Site, the Customer declares that he/she has read all the information provided during the purchase process and fully accepts the terms and conditions of use and payment transcribed below, as well as MORODER’s general conditions of sale. These terms and conditions, together with the conditions regarding the terms of delivery and payment for the goods, form an integral part of the purchase and sale agreement concluded between the Client and MORODER. Therefore, MORODER urges you to read these terms and conditions and general terms and conditions carefully, print them out, or otherwise keep a copy.
Method of Purchase
The Customer may purchase the products visible at the WEBSITE ADDRESS, illustrated on the main page of the Site within the respective sections by product category and brand, as described in the relevant information sheets. Products posted on the site, once the cart is filled and gone through check-out, can be:
“Available for order,” i.e., physically in MORODER’s warehouse or at the manufacturer’s and therefore orderable by the Customer.
“Pre-order available” In this case, the product can be ordered by the Customer even if it is not physically available in MORODER’s warehouse or from the manufacturer. MORODER will order the item chosen by the Customer from its supplier. The time required for MORODER to receive these products varies between 5 and 30 Business Days.
In order to make purchases, it is necessary for the Customer to have a registered account with the Site, or the Customer may choose to make a “quick check-out” without having to create a permanent account. At the time the purchase is made, the Customer has the opportunity to choose the Mode of Delivery and Payment they prefer.
Acceptance of the order by MORODER is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Client when registering on the Website, during the quick check-out or in the billing information in case it has been changed.
MORODER reserves the right, at its sole discretion, not to accept the order. The Client agrees to verify the correctness and veracity of the data in the order confirmation email and to promptly report any system errors to MORODER.
The order confirmation email contains the following data:
– Order number and date
– Product(s), quantity, price
– Type of payment chosen
– Cost of Transportation
– Total order amount
– Pricing
The selling prices of products posted on the Site do not include VAT.
Competent Court
For the resolution of any civil disputes arising from the interpretation, execution and termination of this distance sales contract, if the Customer is a consumer (i.e. a natural person who buys the products not for purposes related to his professional activity) the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in Italy (Art. 63 Legislative Decree 205/2006). If the Customer is a company or a professional (i.e. an individual who purchases the products for purposes referable to his or her professional activity) any dispute however related to these Terms and Conditions of Use and the General Terms and Conditions of Sale shall be devolved to the exclusive jurisdiction of the Court of ANCONA
Terms
These Terms and Conditions of Use and General Terms and Conditions of Sale shall remain valid and effective until amended and/or supplemented by MORODER.
Any amendments and/or supplements will be effective from the date of their publication on the website.
